By placing an order it is assumed that these Terms and Conditions have been read, understood and accepted, and there are and will be no verbal exceptions. Please sign and fax or mail to Nest & Cot, Ltd.
Placing Orders
All orders must be placed by fax or U.S. Mail, and changes to any existing orders must be made in writing. We must confirm all orders received and changes in writing. If we do not confirm in writing then the order or change has not been accepted by Nest & Cot. All orders must be accompanied by a 50% deposit of the retail price and the balance is due at the time of painting of the furniture, which usually is 1 to 2 weeks prior to shipping. Every piece of furniture is made and finished to order, therefore no orders can be returned for any reason.
Payment & Terms
We accept Visa, MasterCard and American Express. Checks will be accepted, however, we will not ship out any furniture for 10 working days after receipt of the check. Orders cannot be cancelled or changed after five days of order being received and processed. If the order is cancelled after the 5 days for any reason the 50% deposit will be forfeited. Orders shipped within Texas require having a copy of your resale certificate. Customer is responsible for wrapping and shipping. We do have recommendations of carriers, but the shipment must be handled directly with the shipping company.
Damages & Claims
Damages sustained in transit are the sole responsibility of the freight carrier. If a packaged item is opened, punctured, or looks as if damage may have occurred, examine contents in the presence of the driver. All damages must be noted on the freight bill at time of delivery and taken up with the carrier immediately. Note any visibly damaged to any cartons or shortages directly on the Bill of Lading and Keep all packaging materials. Any damage not noted and/or documented may result in your claim being denied. Manufacturer defects or concealed damages must be reported in writing within three days of receipt. After this time has elapsed, we will no longer assume responsibility. Our pieces are made with poplar. Cracks occurring which are non-threatening to the structure of the piece are not to be considered a defect. Our furniture is inspected thoroughly prior to shipping and is accepted by the carrier in good condition. Once the carrier has accepted freight, our responsibility ends. No returns will be accepted or refunds will be issued due to damage during shipping.
Finishes
Due to variations in texture of wood grain and differences in finish dye lots the actual finished product may vary from previously ordered pieces and samples. We cannot guarantee an exact match every time. But, we will make every effort to keep our pieces consistent in the finish.
Custom Furniture
We require a sketch, picture or diagram with exact specifications when ordering custom furniture. We will fax you a quote within 72 hours. We cannot be held accountable for any miscommunications between your customer and showrooms. Custom orders will be completed based on specifications given, and all custom orders must be paid in full prior to the work starting. We reserve the right to all custom and sample designs, and the right to use them in our collections. All dimensions are approximate to within one inch.
Shipping Cost

Completion Time
Completion time is 12 to 16 weeks from receipt of deposit, with the balance due of amount due when the item(s) are ready to be stained or painted.
Wood Types & Construction Features
We must know in advance if a piece is to be stained or painted.
We use poplar which is a hard wood on all of our products.
We use 100 pound steel slides on all of the drawers.
Wood Knobs are standard on all pieces.
Armoires come standard with 2 drawers, 2 shelves, and 1 clothes rod.
Some of the pictures in our catalog or on-line may depict pieces with upgrades. Please note that if the upgrade is/are not reflected on the invoice that the items you receive may be different from the picture.
Wood has character and each piece is as individual as any person. Although we strive for uniformity, wood takes paints and stain differently and not every piece of our furniture will look the same as another, or as a picture you see.
